These Terms of Use ("Terms") govern your access to and use of pitinfo.com ("the Site"), operated by Minebright Inc. ("Minebright," "we," "our," "us"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. About the Site
The Site is an informational and marketing resource that describes Pit Info, our mine-to-mill reconciliation software, and the engineering services Minebright provides to mine operations. The Site is not the Pit Info product itself; access to the product is provided separately under a written agreement with Minebright.
2. Permitted use
You may use the Site to:
- Read about Pit Info and Minebright.
- Submit our contact form to start a commercial conversation.
- Share links to publicly accessible pages of the Site.
You agree not to:
- Scrape, copy, or republish substantial portions of the Site without permission.
- Use automated systems to make repeated submissions or send unsolicited messages through the contact form.
- Interfere with the operation of the Site or attempt to gain unauthorised access to it.
- Use the Site in violation of applicable law.
3. Intellectual property
All content on the Site — including the Pit Info name, the Minebright name, logos, text, design, screenshots, diagrams, and code — is owned by Minebright Inc. or its licensors and is protected by copyright, trademark, and other intellectual-property laws. You may not reproduce, modify, distribute, or create derivative works of any Site content without prior written permission.
Third-party vendor names referenced on the Site (Wenco, Modular, Hexagon, Maptek Vulcan, Leapfrog, Surpac, OSIsoft PI, AVEVA, and others) are the trademarks of their respective owners. Their mention indicates integration compatibility and does not imply endorsement or affiliation.
4. Contact-form submissions
Any information you submit through the contact form is governed by our Privacy Policy. Please do not include confidential, proprietary, or sensitive information in your initial message. We will sign a non-disclosure agreement before any operational data is shared.
5. No warranty
The Site and its content are provided "as is" and "as available." To the maximum extent permitted by law, Minebright disclaims all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability. Screenshots, figures, and comparative statements are illustrative and based on our engagement experience; results vary by operation, ore body, and configuration.
6. Limitation of liability
To the maximum extent permitted by law, Minebright shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, revenue, data, or goodwill — arising from your use of the Site, even if advised of the possibility of such damages. Minebright's total liability for any claim arising from your use of the Site is limited to CAD $100.
7. Third-party links
The Site may link to third-party websites. Minebright does not control and is not responsible for the content, policies, or practices of those sites. Following an external link is at your own risk.
8. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be brought exclusively in the courts located in Toronto, Ontario.
9. Changes to these Terms
Minebright may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
